In order to pass SQE2, candidates must obtain the overall pass mark for the assessment. The pass mark will be set using borderline regression to determine the ‘raw’ pass mark in the Practical Legal Skills Assessments on each assessment. Here, examiners are asked to complete both a checklist score and a global score on a five-point scale. Both scores are collated from all examiners, and the global score is then statistically regressed against the checklist score to produce a pass mark. In essence, an overall view is taken of whether or not a candidate reaches the standard of a newly qualified solicitor in England and Wales.

The mark of those candidates who are judged borderline is then used to determine the pass mark. A correction will be made for error measurement in the test using standard psychometric procedures (SEm). In this way, a pass mark that is empirically justified is established. Following the examination the assessment will be reviewed statistically to confirm its reliability (coefficient alpha) and accuracy (SEm). Equality impact assessments will be conducted as appropriate. The marking of the assessment will be subject to review by External Examiners appointed by the SRA.
